The last protectorates. Peacebuilding lessons from the United Nations transitional administrations in Kosovo and Timor-Leste

In the last decade of the 20th century, the Security Council used a tool that had previously been little utilized: temporary administrations over territories that experienced high-intensity conflicts. These administrations clearly demonstrate the broad powers of the United Nations. They are also important for understanding the subsequent development of international systems...

Children’s gender identity and human rights: new practices, new paradigms on the international scene

From the depathological version of the trans phenomenon, we analyze the new practices that international human rights law requires of States regarding the recognition of the right to self-perceived gender identity in childhood, based on a series of historical, theoretical and conceptual assumptions that have given rise to its recent study. At the end, reference is made to the...

Towards a special court for the crime of aggression in Ukraine. An (im)possible path

The prosecution of crimes committed within the armed conflict in Ukraine is probably the most arduous challenge faced by the international criminal system since World War II. The involved actors have not ratified the International Criminal Court Statute, and the alleged implication of an active head of state and permanent member of the UN Security Council (Russia) with veto power...

The defense of collective rights with erga omnes obligations in international law: A new paradigm of international responsibility

Following the judgment of the International Court of Justice in the Barcelona Traction case, the concept of obligations erga omnes was introduced to international law. Despite similarities with the actio popularis, these procedural figures differ fundamentally. However, both aim at the same end: to enforce the rights that correspond to a collective. It is through the erga omnes...

Revising neo-liberalism in international law: indirect expropriation and norm change

This article zooms in on the rather unexplored history of indirect expropriation in international investment law. It argues that two major shifts have taken place in its evolution since its inception around 1917. The first concerns its transition, throughout the 1960s and 1970s, from a residual norm protecting investors while accommodating the right of states to pursue public...

Purchased nationality: A functional approach to address the risks associated with its recognition by other states and the exercise of diplomatic protection

This paper focuses on reviewing the validity of citizenship by investment programmes with international law. This paper will demonstrate that what the Second Judgement of the Nottebohm Case of the International Court of Justice really intended was to rule against naturalizations granted contrary to the general principle of law prohibiting abuses of rights. Moreover, this paper...

The many lives of effet utile in treaty interpretation
